Practice guide with forms for practitioners and judges for use in the growing number of international tort lawsuits filed in our federal and state courts seeking recovery against foreign or domestic parties for actions or injuries that may have occurred abroad. The book provides a road map for lawyers litigating cases, representing both plaintiffs and defendants, including discussions of the key cases. It also provides courts and parties with frameworks for analyzing issues specific issues and discussions of the competing lines of reasoning other courts have used when faced with similar questions. In addition to legal analysis, the book provides practice considerations for lawyers navigating through the complicated issues often raised in cases involving foreign parties from evaluating cases, service of process, discovery, to enforcing judgments, as well as a variety of practice forms drawn from actual litigation, including form discovery requests, procedural and substantive motions, and exemplar court orders. The forms will allow practitioners to focus their time and resources on enforcing their clients' rights, rather than on re-creating documents addressing issues that have arisen in similar cases.
