Summary
Financial services modernization in 2002, this annual ALI-ABA advanced course of study addresses the ongoing implementation of the Gramm-Leach-Bliley Act. There is little question that the Gramm-Leach-Bliley Act is changing the ways in which banks, savings institutions, broker-dealers, insurance companies, investment companies, and investment advisers operate and are regulated, and the scope of the powers they can exercise and lines of business in which they can engage. Lawyers in private practice who represent financial services companies, as well as lawyers employed by financial services companies, are finding it necessary to be conversant with the provisions in the Gramm-Leach-Bliley Act to counsel their clients' complex activities in this new age, since January, 2000. To assist in that learning process, the course is presented roughly along the lines of the principal Titles in the Act, i.e., (i) permissible activities for financial holding companies and banks and alternative methods for owning depository institutions, (ii) functional regulation of bank securities activities, (iii) functional regulation of insurance activities, and (iv) privacy.
