This practice guide is intended to direct the practitioner through the probate process and to point out various tax requirements and planning opportunities. The lawyer must be sensitive to the various fiduciary capacities in which he or she acts as attorney for the estate, as advisor to the devisees/beneficiaries, as an officer of the Court, as a fiduciary, or in a combination of roles. This is an introduction to estate administration, including the preliminary gathering of information necessary to administer an estate efficiently. While serving as a guide to probate and tax procedures, this book is not intended to be a substitute for a practitioner's knowledge of local probate procedures or for a practitioner's awareness of relevant tax considerations. Thus, basic tax knowledge is assumed in the sections dealing with tax planning and tax return preparation.
