Summary
On February 2, 1841, a special committee of the Massachusetts Senate reported on increased county balances. The Committee said the Attorney General had reported in 1839 that much of the increase was from billing the Commonwealth for court costs in various county courts. The Committee provided a history of the practice going back to 1817. The committee offered a bill: An act relative to the costs and expenses of criminal prosecutions. Two-thirds of the cost of criminal prosecutions would be paid by the Commonwealth, unless one party to the prosecution had to pay. The remaining third would be paid by the counties. County treasurers could only bill for the two-thirds amount.
