"Whenever any railroad companies, which have been or may hereafter be chartered by the legislature, shall fail to agree upon terms of connection, or the rates at which passengers and merchandise coming from the one shall be transported over the other, the supreme judicial court holden at any term, in any county in which either of such connecting roads shall be located, on application of either party, and after such notice to the other as the court shall direct, shall appoint three commissioners to determine the matter."--Page 1-2.
