The question of whether the systems-theory paradigm can be fruitfully applied in the field of jurisprudence is affirmed by the author with respect to the analysis of the reciprocal relationship of art, economy, state and law. The starting point is a socio-historical reconstruction of, and a sociology-of-art reflection on, the autonomy of the art system. With the theory of a structural effect of fundamental rights, the author then presents an understanding of the freedom of art that is able to integrate both the free-speech aspects of art and the public policy instruments that are supposed to promote this freedom. The criticism of TV advertisement-breaks and concrete proposals for new regulations on state aid for the arts and private art sponsoring finally show the practical benefits of the systems-theory approach.
