"This portfolio analyzes the Emergency Medical Treatment and Active Labor Act, 42 U.S.C. ʹ1395dd, at times referred to as the federal patient anti-dumping act, which requires hospitals participating in the Medicare program to provide all individuals who come to the hospital emergency room seeking evaluation and treatment an appropriate medical screening and, if an emergency medical condition exists, to provide necessary stabilizing treatment or an appropriate transfer. This portfolio, utilizing the authors' collective experience in advising hospitals on EMTALA issues, focuses on prevention, highlights key EMTALA compliance problems (including the tension between managed care pressures on hospitals and EMTALA patient-protection requirements), and suggests practical, experience-based approaches to avoiding EMTALA violations."
