"In June 2011, the Washington Supreme Court handed down its seminal decision in the case of Roe v. TeleTech Customer Care Management (Colorado) LLC, holding that TeleTech was permitted to enforce its zero tolerance drug policy by terminating the employment of an individual who used medical marijuana for her chronic migraine headaches. Our firm, with Jim Shore hading the litigation, represented TeleTech in that matter, sparking our interest in what has become a rapidly evolving field of law. The changes and developments that have occurred in the few short years since the Roe v. TeleTech decision was issued are astounding - starting with Washington and Colorado's legalization of recreational marijuana barely a year later. The dichotomy between the illegality of cannabis under federal law and its legality under many states' laws creates truly unique pitfalls, considerations, and concerns.
